Buying and Selling Businesses Business Debt Collection
Clear, practical legal support
for business debt collection
We have extensive experience in providing Independent Legal Advice (ILA) to individuals who are asked to enter into personal guarantees, joint borrower arrangements, or other financial commitments.
Our specialist solicitors ensure you fully understand the legal and financial implications of the documents you are signing, protecting your interests and meeting your lender’s requirements.
Independent Legal Advice is often required by lenders, banks, or solicitors in situations where:
A personal guarantee is being given for example, where a company director guarantees a company’s borrowing or lease obligations.
A joint borrower, sole proprietor arrangement is in place, where two people are taking out a mortgage together, but only one will be named on the property title (commonly used to meet affordability multiples).
A third-party mortgage or financial agreement is being entered into where the lender must confirm that the individual has received independent, impartial advice and is acting freely.
The purpose of ILA is to confirm that you fully understand the risks, obligations, and potential consequences of the commitment, and that you have not been pressured or misled into signing.
Before your appointment, we will review all relevant paperwork, including the lender’s ILA pack, loan agreement, and any supporting documents.
You will meet with one of our solicitors, either in person or via a secure video appointment, depending on your lender’s requirements. We will explain the documents in clear, practical terms and answer any questions you may have.
Once you are comfortable with the advice provided, we will witness your signature on the necessary documents.
Finally, we will complete the solicitor’s certificate or declaration confirming that you have received independent legal advice and return it to your lender or their solicitor promptly.
We recognise that Independent Legal Advice is often required quickly to allow a financial or property transaction to proceed. Our experienced solicitors provide an efficient, professional, and approachable service to ensure your matter is handled without delay.
With offices in Burgess Hill and Lewes, we offer flexible appointment times and clear, fixed fees so you can be confident about costs from the outset. Whether you are providing a personal guarantee, joining a mortgage as a non-owner, or assisting a family member, Bennett Oakley Solicitors will guide you through the process with clarity and care.
